Animal Testing: Not Very Reliable or Safe for Human Safety

Animal Testing Nowadays there are many companies that test their products on animals such as makeup and painkillers. Not many people pay attention to this fact, but in actuality they should. Excuses for companies using animals for testing are that they have similarities in their tissues and DNA. Though parts of the human body vs. an animal’s body may have similarities but people must keep in mind that we are two totally different species. Science shows that animals rarely serve as good models for the human body so why would we feel safe with the product anyways.The best thing for us to do is test out products on other humans so then we can get reliable and accurate results. The Food and Drug Administration (FDA) stated that 92% of all drugs that are shown to be safe and effective in animal testing fail in human trials; from this information you can see that testing on animals isn't very reliable or safe for our safety and health. Also, it was said in multiple science journals that testing on animals would be a waste of time and life, both human and animal. Testing on animals is dangerous for both species.Other than the lack of similarities between the two, animal testing could lead to the spread of disease. For example, say my company is testing a new allergenic pill in chickens but it goes terribly wrong s d ills the animals, now I must find a way to dispose of them and if it’s not done properly, and someone gets their hands on the one of the tested animals and tries to eat it there's a high possibility that the consumer will become ill as well and end up spreading their illness to surrounding people, causing an outbreak. This could all be prevented if animal testing were to be banned. Thankfully, as of right now this has yet to happen, YET.Once again, we shouldn't test our products on animals because animals are helpless and have no say in the matter. With humans, we are able to voice our opinion and position on a subject so if we are Bering ask ed of something that we aren't comfortable participating in, then we don't have to, on the other hand; an animal cannot in any means voice their opinion to a human. If they don't wish to partake in these trials how would we have any way of knowing? More on, if you are I keep forcing these animals to participate in these tests this will make the animal vicious and dangerous leading on to having to ‘put down' the animal.If you keep abusing a species like this over time, you will be seen as a threat and that will be taught to the offspring, so in and so forth. If that were to happen we shouldn't even hope to get close to that animal anymore, they are traumatizing these species. Furthermore, animal testing is absolutely pointless because it is taking up entirely too much if the government’s money. We, as a hole, ate already in debt to chins at 1. 16 trillion dollars, but we choose to continue paying just about 200billion dollars in a yearly basis to animal testing just fit cancer alone.

As such, some of them are capable of manipulating the information about the African American history. Studying the leadership of these African Americans is important because they epitomize how people struggle in order to fight for their rights. They also embody a turning point in the United States history because it was due to their leadership that the country reassesses their idea of freedom and democracy. Furthermore, it plays an important role for the country to understand the present state of African Americans as well as the development and areas for improvement of the situation of these people. Moreover, the lesson learned from this experience would aid the people to make things better so that the mistakes done in the past would not happen again.

Extreme Motivation Essay

What do employees want and why do they want it? In today’s business world, companies are employing a plethora of motivational techniques, in order to increase their profits. Human resources departments use a merit based motivational program, an approach that focuses on the esteem of the employee, or a combination of both. The merit based, pay-for-performance program, employed by Jack Welch, uses money to motivate high performance, whereas the other approach focuses more on helping an employee feel better about his or her self, which will lead to higher performance. Neither method is right nor wrong, it depends on the organization. The organization needs to make sure it is meeting the needs of its employees. Maslow’s hierarchy of needs suggests people must satisfy five groups of needs in order-physiological, security, belongingness, esteem, and self-actualization. Concerning Maslow’s theory in terms of pay-for-performance, it can be analyzed under each of these five areas. The physiological need is the lowest in the hierarchy, and is generally the easiest to fulfill. This physiological level is the necessities and is usually entry level of pay, which is adequate to motivate a worker to pursue the desired position. Once a person attains the physiological level, security is the next need in line. Security is having the feeling of job security. Pay raises and pension plans are money motivators, thus keeping the employee motivated in achieving company quotas and goals in the long term. Social processes describe belongingness needs in Maslow’s hierarchy. A company that provides an indirect monetary reward through a social gathering satisfies this need. A social gathering helps co-workers develop personal and business relationships with each other. Esteem can be divided into two subcategories, self-respect and respect gained from peers. Monetary forms of company provided benefits such as larger offices, job titles and raises could suit this category. The most difficult level of the hierarchy to reach is self-actualization. According to â€Å"Management with Exercises in Management, â€Å"[†¦] it can be argued these needs must be met entirely from within the individual† (Griffin, 2008, p. 439). Even though self-actualization rests with the individual, a manager can promote an environment where one can realize his or her own potential. With the pay-for-performance incentive plan, one can achieve self-actualization by reaching their goals and receiving a direct reward for the performance in the form of money. Money is not the only motivating factor, as displayed by a company named Seagate (Griffin, 2008, p. 463). With respect to Seagate’s motivational strategies, one must satisfy five groups of needs in order, physiological, security, belongingness, esteem, and self-actualization. The company decided their circumstance was dire enough for drastic measures. Seagate sent 200 managers to a weeklong adventure race in New Zealand. Providing food, water, and air at the adventure retreat, fulfills the managers’ physiological needs. In the racing tasks, the employees learn how to depend and trust each other, thus gaining each other’s security and fulfilling the security need. Belongingness is an important aspect in a career. An individual spends more than forty hours a week with their work family. It is very important that one have a good rapport with their co-workers, in order to achieve self-actualization. In the adventure retreat, the ending task is the race itself. For each leg of the adventure race, you must rely on your teammates and co-workers to complete the race together. The participation of all the employees fulfills the esteem area. Everyone is equal, honest, and encourages building the esteem of all participants. Self-actualization is the final level and most challenging to achieve. At the end of the retreat, participants leave with a new self-awareness and feel they were able to open up to their colleagues. This retreat gives everyone an important role on a team and creates dependence upon each other in order to complete tasks. This team building experience gives individuals the potential for growth and creates an open environment. Every organization has different ideas concerning motivation; Jack Welch is more of a pay-for-performance man (Griffin, 2008, p. 463). When it comes to motivational theory, Jack Welsh, former CEO of General Electric, thinks that financial rewards are the most important. Jack Welch said it best, when he said, â€Å"No company, large or small, can succeed over the long run without energized employees who believe in the mission and understand how to achieve it† (Gallo, 2008). Mr.  Welch firmly believes money is the most important factor in motivating employees in reaching their goals. Two different motivational theories discussed in â€Å"Management with Exercises in Management† correlate the incentive process of the workplace (Griffin, 2008). The expectancy theory is the first theory that relates to Welch’s money incentives. The expectancy theory â€Å"depends on two things—how much we want something and how likely we think we are to get it† (Griffin, 2008, p. 442). The expectancy theory states that if an incentive is there for an employee, the employee must also feel they have a chance to earn it. For instance, if a company offers a monthly bonus of $1000. 00 to an employee to reach a certain goal, the employee must feel they have a chance to reach that goal as well. If the employee does not feel they can reach the goal, even though the bonus is monetary, they will not attempt to reach the goal. Jack Welch also utilizes the reinforcement theory in his approach. The reinforcement theory contends, when positive behaviors are rewarded, they are more likely to be repeated (Griffin, 2008, p. 448). Mr. Welch has a reputation of rewarding his employees with cold, hard cash. By rewarding high performing employees with money, Welch demonstrates he rewards behavior benefitting the company. These monetary rewards are going to motivate the other employees to perform at a high level as well. Motivation seems to have pros and cons when it comes to an organization or firm. Seagate, a Silicon Valley firm, explains why retreats are motivating to workers. Seagate’s tactics are a combination of a human relations and a human resource approach to motivation. The human relations approach emphasizes the importance of social processes in the workplace. Employees want to feel useful and important, have strong social needs, and these needs are more important than money when it comes to motivation (Griffin, 2008, p. 436). Managers give workers the feeling of importance by allowing them some power and control over their daily operations. For example, a manager will allow a team or an individual to provide input on a decision, although the manager already knew the result. This method satisfies basic social needs, therefore, results in higher motivation, which helps individuals reach self-actualization. Another motivational approach one may use would be a human resource approach. The human resource approach takes the concepts of needs and motivation to another level. The human relationists believe the illusion of contribution and participation enhances motivation. The human resource view adds that the contributions themselves are valuable to both individuals and organizations (Griffin, 2008, p. 437). People are able and want to contribute. Management needs to make full use of the available human resources by promoting participation and team building. Carla Cavanagh (2010) believes a human resources approach is a great way to train middle managers, and one could even argue it could extend to the rest of the employees. Cavanagh believes there should be a mutual trust between employees, they should be appreciated, conversed with, involved with decisions and their growth stimulated. When this much attention is shown to an employee, they become empowered and motivated to perform at a high level (Cavanagh, 2010). Seagate’s employees are motivated because, each year, selected managers participate in a weeklong retreat in New Zealand. During the event, they learn important characteristics of a strong culture that endorses trust, accountability, and healthy competition. In addition, they work on skills for adventure racing. When they return to work, the managers apply what they learned to their division (Griffin 2008, pp. 463-464). This environment places individuals in a position that they must ask teammates for help in order to complete tasks. The ability to ask for help eliminates major roadblocks within a team or organization. When an employee can ask for help, they open up to other employees. They begin to fill a social need and therefore, a level of trust. The employees also allow themselves to receive input from another team member or management. When members of teams or work groups give and accept ideas, they can collaborate and solve many issues. This in turn gives the employees a feeling of contribution and provides the organization with resolutions to problems. Everyday companies are looking for new ways to motivate their employees to perform at higher levels more efficiently. There are so many different theories and approaches to motivation, which forces companies to research several different avenues before finally arriving with a solution. Jack Welch and his pay-for-performance method can work in one environment, but a human resource method may work best in a different environment. The success of a motivational strategy essentially depends on the organizations culture, and its leaders. As long as an organization can work off Maslow’s hierarchy as a template, they are on the right path to motivating employees, improving performance, and increasing profits.

Chapter 4 Findings Findings are derived from qualitative and quantitative analysis. Data analysis is meant to calculate correlations between variables. The intention is to find relations among the variables. Correlation is a measure of the degree of linear relationship between two variables. A positive correlation occurs when both variables either increase or decrease. Negative correlation occurs, when one variable increases and the other decreases. Issues of Company Co-Ownership MEMORANDUM 1 i. When in a state of co-ownership, the decision to make alterations and repairs is one in which it is necessary, that both parties must have made a common agreement before any changes are made to a property.[1] It should also be noted that in previous cases where exceptional circumstances arise and the property is in need of necessary repairs that any one of the co-owners is able to make changes to the property.[2]. This can be determined by firstly and very basically establishing that they are in a co ownership,[3] and also that the case provided sees changes made to the property are not repairs as defined as necessary operations in rebuilding, repairing.[4] This means a unanimous agreement was therefore necessary and that the only other way Victor would be entitled to make the changes are seen in Rafique v Amin in which personal bar is referred which would only be relevant if Jack already knew about the changes that were going to be made but chose to do nothing as even though no agreement was reached yet no objection was made. This is also seen not to be the case as Jack was not present or notified at the time of the alterations. Since alterations (not repairs) have been made to the property and not minor changes that are permissible, it can be quite clearly stated that Victor was not permitted to carry out such alterations on the flat. On the one hand there is room for Victor to plead that what is being proposed is so trivial as to fall within the principle enshrined in the brocard à ¢Ã¢â€š ¬Ã‚ ¦ [5] , on the other hand it seems that the changes made could be classified as more than trivial so it seems that Victor was not entitled to carry out the changes made to the property. ii. The issue of whether Jack can do anything to prevent Victor from making more changes can be rather complex. As found in Barkley v Scott(1983) 10 Sh Ct Rep 23 and owner is quite entitled to make changes to a property as long as they are regarded as de minimis meaning that they are minimal such as previously mentioned above.[6] This would be a an ordinary use of the property in which Jack could not prevent although would need further enquiry. It should also be noted that unauthorised actions will become subject to an interdict. This would prevent Victor from carrying out any more alterations to the property. Such action would require court action which in multiple cases sees declarator granted along with interdict and on occasion a reinstatement in favour of the pursuer who at the time was not contacted.[7] It seems that in this case to stop Jack making further amendments an indictment would have to be placed upon him with the penalties for breaking such indictment becoming ever more serious.[8] So, it can be said with absolute certainty that the common proprietor has the right to veto that will therefore prevent further alterations on the property regardless of whether the property they are disputing over is able to be sold or not.[9] On occasion the pursuer often seeks for a financial return through damages. This would see Victor have to pay for the damage he has done, although often the amount to pay out through damages is hard to quantify[10] and it has been said that for a breach there has to be shown to have suffered material damage from such a breach[11]. For that reason, sometimes the repayment of damage maybe in this case is not suitable. So, it can be said that perhaps indictment is one of the most feasible routes here to prevent Victor from making further changes to the flat. Often, this results in Jack who has been greatly inconvenienced to look to dispone his shares of the flat. This would be at Jacks discretion as whilst not directly linked to preventing Victor from making further unwanted changes to the flat this often occurs when there is a break down in cooperation and in practice the best remedy for this is actually the sale and division of the property. iii. Despite it being clear that Victor does not want Jack to sell the property it can be hard to prevent. The selling of a property is of thought to often depend on, mutual compatibility goodwill, and understanding.[12] Providing that this still exists between Jack and Victor the usual step would be to sell shares of the property or sell the property as a whole. It is said in Latin that both in communionemà ¢Ã¢â€š ¬Ã‚ ¦ nemo compellitur invitus detineri[13] and that regardless of the relationship communion est mater rixarum.[14] This is particularly significant in Victors case as it means that if the issue is raised in court each party as pro indiviso owners has an absolute entitlement to the right of division and sale.[15] When the division and sale takes place the property will either be sold all together and then split between co-owners or the property is physically divided into the extent of the shares so in this case it would be evenly split. This does seem to then favour division of the property which would prevent sale however, in a situation where it is seen as far from practical or grossly unsuitable it will end in the sale of a property.[16] This is very much so relevant to issues involving common property that cannot be sold at all such as a commonly used stairwell,[17] or that the co-owners are married in which case would have separate rules or that one of the co-owners has been sequestrated, both are irrelevant to Jack and Victor.[18] It is even possible that it is not sold on the market and that Jack can ask Victor to transfer his share of the of the property to him for half its value, however this is the right to buy out is a contentious one but entirely plausible. It seems therefore, that there is very little Victor can do to prevent Jack from selling the flat. iV. As said previously situations in which property is sold is entirely different for married couples as they follow a separate set of rules regarding the sale of property between co owners. In Jack and Victors current situation at common law both cohabitants initially had no legally recognised status. Although unmarried separation rights are the exact same in property terms when the relationship breaks down it is then they are both distinguishable. Due to Jack and Victor not being married if their relationship was to break down their property would be divided into his his and theirs[19] where each couple will claim exactly what is they individually own. This is different if Jack and Victor were married as if they were then the property would be divided into what it is felt each party needs, like in some cases for example, the husband will leave the matrimonial home to be transferred to his ex-wife, along with the fact that matrimonial couples are seen as one unit rather than being treat ed as complete strangers. As at the end of a relationship in divorce it is to be shared equally[20] as special circumstances can be accounted for and these decisions are generally fully down to judicial discretion as it is then that it is decided to what property the property can be valued as. to what value it has. As at the end of divorce it is all calculated towards a figure as matrimonial property seems to only have significant importance during divorce proceedings which can lead to money being exchanged to make a property transfer order. [21]These are considerations Jack and Victor dont need to currently make as they are not married and the only Act that would apply to cohabitants would be the Family Law Scotland Act.[22] This only goes as far as giving the option of financial provisions and also to make sure that goods are perceived as co owned, cohabitants have similar but not entirely equal occupancy rights (such as occupancy rights only up to 6 months ) as contained in the M atrimonial Homes Act 1981. This highlights the problems of couples who live together outside of marriage (such as Jack and Victor) face when their relationship breaks down as while they have some rights protected by some Acts they are not as greatly protected as married couples are. i A lease can be defined as a contract between one person who grants permission for the other to use their property for a set amount of time in return for payment, which is known as rent. There are 3 types commercial, agricultural and residential property. Navid seemingly falls into the commercial property bracket. There are 4 main elements for a valid lease to be present. The first is that there must be a general agreement between the two parties the lessor and the lessee. Secondly, there must be property. The lessee must be given possession of the property and unless in special cases such as shooting rights which can be leased although this must be clarified so the subject of the lease is found.[23] Rent is another which is usual paid periodically and in most circumstance on a monthly basis but can be paid in various different ways such as through services and not only through money.[24] The court may also find a lease exists as long as the other three elements are found.[25] Finally for a lease to be valid there has to be a duration on the lease. So in theory it is allowed for a lease to last for many years.[26] So far it can easily be established that both Navid and Isa have a valid lease in place. Furthermore, the formality of whether or not the lease was signed is irrelevant if the lease lasts one year or less, and longer and both parties must have a written agreement.[27] So, if Navid has entered into a lease for over with Isa for it to be valid it is hoped that there was a written agreement in place along with the other four elements listed above. In most cases a lease will contain the rights of both the tenant and the landlord. This is because the lease is recognised by the law with its own set of terms. The first is possession and that the landlord is obligated (so in this case Isa) to give the tenant what is known as natural possession, one that the landlord should not interfere with.[28] The tenant as a consequence must be present in the property with only short absences allowed as without such a possession of the property the lease can be regarded as a material breach such as when a tenant was absent from a prison due to detention in prison.[29] The second reason is that rent must be paid by the tenant when it is due. The reason leases are so short and are often changed is due to changes in external factors such as inflation, if the new rate set is not agreed on it is for the third party to decide, which will see the rent set in line with market rates. Thirdly, the property must be sufficiently plenished by the landlord to a reasonable standard in which it would be expected to be equitable for the payment of rent, as without this an interdict can be put in place against the land lord.[30] The tenant is also obligated to use the property for the purposes of let and may not alter or invert this which will cause a breach of the lease, however, The Landlord is obliged to make sure that the property in question is fit for the circumstances under in which it will be let, which can lead Isa to be questioned on her upkeep of her property. Finally, the property must be maintained by the landlord, so the landlord must carry out the maintenance to the property within a reasonable time and if he does not he is liable.[31] The landlord however is not liable if an Act of God occurs such as a flood, a third party causes damage ( in which case they are liable) or the tenant will be liable if they breach the obligation to take care of a property in which case they will be made to pay. There are reasons for either Landlord or tenant in this situation to bring the lease to an end. Firstly, Isa could feel the need for the lease to end due to the fact Navid has not paid rent for the past 6 months. This is a clear obligation of a lease, and the onus is very much on Navid to pay that money. Without Navid paying that money it can be cause for Isa to take action against Navid the remedies available include what is known as action for payment. This remedy is typically used for situations including this one in which rent is not paid, this results in the execution of the lease which is often found as a clause within the lease. This enables a judge to carry out what is known as summary diligence which sometimes does not even need court action.[32] Isa is also entitled to rescind the lease due to a material breach of a monetary obligation in which it would require her to give Navid a 14 day notice to pay the unpaid rent. Furthermore, Isa herself as a landlord has a right to th e goods brought into the property by the tenant known as invecta et illata for rent. It however, seems Navid has the stronger case as Isa has quite clearly fell short of providing a suitable standard of property due to the dampness that has ruined Navids stock. This entitles him to either; seek damages for the fact the landlord has failed to carry out the required repairs that will leed to Navid suffering monetary loss although defining the quantification of such a breach is difficult to determine. He is also able to seek the remedy of specific implement which sees the landlord required by the courts to carry out repairs on Navids shop. This is a remedy specific to Scottish courts which unlike England do not offer such a remedy to the keep open clause. A final option for Navid is to keep suspending his obligation to pay rent due to Isa breaching her obligation to repair the dampness on the premises as he is very much allowed to continue to retain the rent from Isa as long as he has not been paying her for months when she has been failing to meet her obligations. History of the Malacca Sultanate The Malacca Sultanate was a powerful maritime and commercial empire that Shaped the political, social and cultural systems of the Malay Peninsula. Parameswara (1401 to 1511) was the founder of Malacca. He was a fugitive prince from the Palembang in Sumatra, and attack Palembang. Parameswara fled to the island of Temasik with his loyal company of 30 orang laut (sea people). After eight days in Temasik, Parameswara killed the local chief and usurped as lord over the simple fisher folk of Temasik. Therefore, he runs to Malacca. Under his ruling, in 1414, Parameswara embraced Islam, and change his name to Megat Iskandar Shah, married to a Muslim princess from Pasai, Sumatra. Because of this it attracted Muslim traders to come to Malacca port and international too. He also maintain the good relation with Ming China, he send a mission after mission to Peking in1415, 1416 and 1418. Parameswara, laid a great stress on the element of all event and the political experiences which underwent from broader viewpoint and historical vision in the Malay historical and political development all in Malay Archipelago. Due to the successfully founded and established a seat of power in Malacca around 1399/1400. Upon his death in 1424, Megat Iskandar Shah was succeeded by his son Sri Maharaja (1424-1444) . He was the first to use Arabian title of Sultan, and formulate the Malacca Laws known as Risalah Hukum Kanun in protect the sovereignty and prosperity of Malacca. Raja Kechil Besar (Sultan Muhammed Syah, 1424-1444) played a major role in developing and improving the ceremonial and the administrative system. He re-organized the royal administration. In Malacca the Bendahara immediately beneath the sultan operated as Chief Minister with Temenggong as Senior Judges below, followed by Special Magistrates or Syahbandar. The main four communities in Malacca, Muslim Gujaratis , Hindu Tamiuls , Islamised Javanese and Chinese each a Syahbandar. The Syahbandar have two roles, the Chinese Syahbandar will assisting the vessel in trades when foreign ship arrived from China. So as the Shahbandar looked after h is respective community. Syahbandar will need to responsible for arming, organizing and commanding their community for Sultan. Two offices or ministers were created at this time the Temenggung and Sen Bija Diraja is to the rapid developments that were taking place in the town and society of Malacca. The office of the Laksamana was established during the reign of Sultan Mansur Shah (1456-1477). It was originally designated by the Emperor of Majapahit. The duties and jurisdiction of the Laksamana were similar those of the Seri Bija Diraja. As the position of the Laksamana became more firmly established and more influential in Malacca, the status of the Sen Bija Diraja gradually declined. Beside the four Ministers, there were eight senior directors, all bearing the title Sr. Under them were sixteen junior directors with the title Raja. At the bottom of the hierarchy were thirty two government offices that assist the Minister to carrying out their duties. This administration system was implemented by all the states in Malay Peninsula that were united under Sultanate Malacca. Malacca was as a major player in the spice trade, serving as a gateway between the Spice Islands and high-paying Eurasian markets. The rise of Malacca was the monsoon winds that enabled Arabian and Indian traders from the west to travel to China in the east and vice versa. It was also the center of Islam in the eastern sphere, were also sent by the Sultan to spread Islam to other communities in the Malay Archipelago, such as in Java, Borneo, and the Philippines. Most of South East Asia at that time was Hindu. The Sultanates most important regional rivals were Siam in the north and the declining Majapahit Empire in the south. Majapahit was not able to control or effectively compete with Malacca within the archipelago. Siam on the other hand attacked Malacca three times, but all attacks were repelled. At the same time, Malacca had a good relationship with the Ming government of China; Parameswara had met the Chinese emperor in China to receive a Letter of Friendship, hence making Malacca the first foreign kingdom to attain such treatment. In 1409, the sultan paid tribute to the Chinese emperor to ask for protection against Siam. This Sino-Malacca relationship helped the attacks from Siam from further threatening Malacca. The empire of Malay Kingdom of Malacca ended in 1511 after the Portuguese attack under the rule of Sultan Mansur Shah (1459 1477) because of several external and internal factors. He is a weak leader and paid less attention to the administration. Due to this matter, he often in-need of power during his ruling. Thus, after Tun Perak died in 1498, to be succeeded by his brother Tun Puteh also a weak leader. After the death of Tun Perak the Chief Minister, the Malay Kingdom of Malacca lacked of efficient leader. The bribing, slander and high taxes forced the merchant to change their attention to other ports. The citizen of Malacca become split in to factions and disunited. Tun Mutahir is a weak leader that caused the Malays to become hostile towards the Indian-Muslim. Malacca State continued to flourish but the court was now thronged and dominated by Tamil merchants. Tun Mutahir and Tun Ali put to death, betrayed by Kitul and Raja Mandaliar, an indian native. Chief Minister Tepok ( Tun Peraks son)was appointed by Sultan after Tun Mutahir death. As a result, is easier for Portuguese to attack Malacca. Malacca become weak and fall prey to their enemies due to weak leaders, bribery and corruption, betrayal among minister and disunity among the people.
